About the Data: While New York municipalities cannot opt out of adult-use legalization, cities, towns, and villages can opt out of allowing adult-use cannabis retail dispensaries or on-site consumption licenses from locating within their jurisdictions in accordance with the Marijuana Regulation & Taxation Act (MRTA).

As a result, 843 out of 1,526 New York’s cities, towns and villages—or 55%—have opted out of allowing adult-use retail dispensaries to operate within their borders.

About New York’s Adult-Use Cannabis Program: New York became the 15th state to legalize adult-use cannabis when the state Legislature passed Senate Bill 854A, which was signed into law by the governor on March 31, 2021. Adult-use sales began Dec. 29, 2022.
